Binding Order Explained: A Promise With a Price on It

A binding order is a promise with a price on it. Both sides are bound, and walking away costs something, which is what separates it from a hope.

The Short Answer

Picture a builder who says to a supplier that a thousand bricks is probably her order. Everyone nods.

Then prices jump and she quietly walks away. The supplier is left with a pile of bricks and no buyer.

What a Binding Order Is

There is a stronger kind of promise. It is called a binding order. Both sides are bound, and walking away costs something.

The builder’s first promise was only a hope. Nothing held her to it.

A Hope Against a Binding Order

The video sets the two side by side. A hope can be dropped for free. A binding order cannot.

With a binding order the supplier can plan around it, and the builder has supply set aside. With only a hope the supplier can only guess, and the builder has no supply.

The Honest Limit

Binding does not mean delivered. The bricks still have to be made, and shipped.

The video adds that the terms are usually private, so the outside world rarely sees what walking away costs.

Where This Shows Up in AI Business Today

AM Intelligence used the term in an announcement on 5 October. Our report on the orders says AMI states it placed two further firm and binding orders for 20,000 NVIDIA Rubin GPUs, about 70 MW, with delivery scheduled for Q2 2027. Our piece describes the three orders as the first committed tranche of a roughly 400 MW pipeline whose balance AMI says is under development, and notes that the $4 billion price is Livemint’s, not AMI’s.
